18 U.S.C. § 2257 Record-Keeping Requirements Compliance Statement

In compliance with the Federal Labeling and Record-Keeping Law (also known as 18 U.S.C. § 2257 and 28 C.F.R. § 75), MyMuse (“the Platform”) makes the following affirmations regarding all visual depictions of actual sexually explicit conduct that appear on, or are otherwise contained in, the Platform.
MyMuse is not a producer
MyMuse is an online hosting service and intermediary. All content published on the Platform is produced and uploaded by third-party creators (hereafter “Producers”) who have contractually agreed to act as the primary producer under 28 C.F.R. § 75.1(c)(1) and secondary producer under § 75.1(c)(2) as applicable.
MyMuse does not itself create, produce, direct, finance, manufacture, publish, duplicate, reproduce, or reissue any of the visual depictions appearing on the Platform. Accordingly, MyMuse is exempt from the record-keeping obligations of 18 U.S.C. § 2257 pursuant to 28 C.F.R. § 75.1(c)(4) (the “safe harbor” exemption for online services that transmit, store, retrieve, host, format, or translate communications of another without selection or alteration of the content).
Creator (Producer) obligations
Every creator who uploads content to MyMuse is contractually bound by our Creator Terms to act as the “Producer” under 18 U.S.C. § 2257. This means each creator warrants and represents that, for every sexually explicit depiction they upload:
- •Every person depicted was at least 18 years old at the time the visual depiction was created. A valid, government-issued photo identification establishing the full legal name and date of birth of every performer has been collected and retained.
- •Written, informed consent has been obtained from every person depicted, authorizing the creation, publication, distribution and commercial exploitation of the content on MyMuse.
- •Records are maintained as required by 18 U.S.C. § 2257 and 28 C.F.R. § 75 (age verification documents, signed consent, 2257-compliant model release, and records of any stage names or aliases used).
- •Those records will be made available to MyMuse and/or to the U.S. Custodian of Records within seven (7) business days of any request, and preserved for the periods required by applicable law.
- •Creators are required to verify their own identity and age to MyMuse (government-issued photo ID + live selfie) prior to being granted publication rights on the Platform.
What MyMuse does in addition
Although MyMuse is not required to maintain § 2257 records as a non-producer, the Platform voluntarily implements the following safeguards:
- •KYC for every creator: government-issued photo ID + live selfie matched to the ID, reviewed by a human moderator before any publication right is granted.
- •Pre-publication review of every uploaded media item (photo, video or message attachment). Content is only visible to fans after a moderator marks it as “approved”.
- •Zero-tolerance policy against child sexual abuse material (CSAM), non-consensual content, revenge porn, and any depiction of trafficking. Any such content is immediately removed, the creator's account suspended, and the case reported to NCMEC and law-enforcement authorities when required by law.
- •Reporting mechanism: any user or member of the public can report suspicious content or flag an individual who appears underage; reports are handled within 7 business days (same-day for urgent cases involving minors).
- •Takedown / right of the depicted person: any individual who is depicted in content uploaded by a creator can request immediate removal via our content removal process, without having to provide a copyright claim.
Custodian of records
Although MyMuse is not itself a producer under 18 U.S.C. § 2257, the Platform maintains a designated point of contact to route § 2257 inquiries to the individual creators (primary producers) who are responsible for the relevant records.

Upon receipt of a compliance request relating to specific content, MyMuse will (a) identify the uploading creator, (b) forward the request to that creator, and (c) cooperate fully with any lawful inquiry from competent authorities.
Statutory exemptions
Certain visual depictions appearing on the Platform may be exempt from the record-keeping requirements of 18 U.S.C. § 2257 because they (i) do not portray actual sexually explicit conduct as defined in 18 U.S.C. § 2256(2), (ii) were created prior to July 3, 1995, or (iii) otherwise fall under an applicable statutory exemption. Creators remain responsible for asserting and documenting any such exemption for the content they upload.
