Welcome to MyMuse ("we," "our," or "the Platform"). By accessing or using MyMuse, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.
MyMuse operates as a hosting and intermediary service. We provide the technical infrastructure for users to share, view, and monetize content. We are not the publisher, creator, or distributor of user-generated content.
1. Platform as Hosting Service
1.1 Intermediary Role: MyMuse acts solely as a technical intermediary and hosting platform. We provide infrastructure, payment processing, and tools for creators and users to interact. We do not create, control, approve, or endorse any user-generated content.
1.2 No Editorial Control: We do not exercise editorial control over content posted by users. Creators are solely responsible for their content, and we act only as a passive conduit for information transmission.
1.3 Safe Harbor: As a hosting service, we benefit from safe harbor provisions under applicable law. We are not liable for user content unless we have actual knowledge of illegal activity and fail to act expeditiously to remove it.
2. User Responsibilities
2.1 Age Requirement: You must be at least 18 years old to use MyMuse. By using the Platform, you represent and warrant that you meet this age requirement.
2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials. Any activity under your account is your responsibility.
2.3 Lawful Use: You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations.
2.4 Prohibited Conduct: You may not: (a) impersonate others, (b) harass, threaten, or abuse other users, (c) attempt to circumvent payment systems, (d) use automated systems to access the Platform, or (e) reverse engineer our services.
3. Creator Responsibilities
3.1 Content Ownership: Creators must own all rights to content they upload or have explicit permission to share it. Creators are solely responsible for ensuring they have necessary rights and licenses.
3.2 Age Verification & Consent: Creators must ensure that all persons depicted in content are 18+ years old and have provided full, informed consent. Creators must maintain verification records.
3.3 Legal Compliance: Creators are responsible for ensuring their content complies with all applicable laws, including but not limited to copyright, privacy, and obscenity laws.
3.4 Prohibited Content: Creators may not upload content that is illegal, depicts minors, is non-consensual, promotes violence or hate, or violates others' rights.
3.5 Indemnification: Creators agree to indemnify and hold MyMuse harmless from any claims, damages, or losses arising from their content or breach of these Terms.
4. Limitation of Liability
4.1 No Warranty: The Platform is provided "AS IS" without warranties of any kind. We do not warrant that the service will be uninterrupted, secure, or error-free.
4.2 Content Liability: We are not liable for any user-generated content. Users and creators are solely responsible for content they post or view.
4.3 Limitation of Damages: To the maximum extent permitted by law, MyMuse shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
4.4 Maximum Liability: Our total liability to you for all claims shall not exceed the amount you paid to MyMuse in the 12 months preceding the claim.
5. Account Suspension & Termination
5.1 Right to Suspend: We reserve the right to suspend or terminate any account at our sole discretion, with or without notice, for violations of these Terms or for any other reason.
5.2 Grounds for Suspension: Accounts may be suspended for: (a) violation of these Terms, (b) illegal activity, (c) multiple content violations, (d) abuse or harassment of other users, (e) payment fraud, or (f) impersonation.
5.3 Appeal Process: Suspended users may appeal by contacting legal@joinmymuse.com with supporting documentation. We will review appeals but are not obligated to reinstate accounts.
5.4 Effect of Termination: Upon termination, your right to access the Platform ceases immediately. Outstanding payments may be withheld pending investigation.
6. Content Removal Rights
6.1 Discretionary Removal: We reserve the right, but have no obligation, to remove any content at our sole discretion, with or without notice.
6.2 Notice and Takedown: We respond to valid legal notices (DMCA, court orders, etc.). Upon receiving proper notice of illegal content, we will act expeditiously to remove or disable access to such content.
6.3 Reporting Violations: Users may report content that violates these Terms. Reports should be sent to legal@joinmymuse.com with detailed information.
6.4 No Liability for Removal: We are not liable for removing content, even if the removal was erroneous. Creators should maintain backups of their content.
7. Applicable Law & Jurisdiction
7.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
7.2 Jurisdiction: Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in [Your Jurisdiction], and you hereby consent to the personal jurisdiction of such courts.
7.3 Arbitration: Disputes may be resolved through binding arbitration rather than in court, except for claims relating to intellectual property rights.
7.4 Waiver of Class Actions: You agree to resolve disputes on an individual basis and waive any right to participate in class actions.
8. Additional Provisions
8.1 Changes to Terms: We may modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
8.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
8.3 Entire Agreement: These Terms constitute the entire agreement between you and MyMuse regarding the use of the Platform.

By using MyMuse, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the Platform.
